Exempt Status Classification

A group of employees claimed that they were improperly classified as “exempt” employees under labor laws and sought to recover unpaid overtime compensation. In preparation for upcoming depositions, Celerity traveled to various locations where time records were stored. Celerity searched through time record reports that were organized on a weekly basis. Each time record was reviewed to identify records that applied to every deponent and also fell within specific time frames. Scanning was performed on the premises. After we received the images, the records were indexed by capturing specified fields of information. Missing time cards and possible locations of the missing records were identified, sorted the records by date, and then provided counsel with a Concordance load file and images on a rolling basis to meet deposition deadlines.
